AffiliatesGarage.com provides You with the ability to display text-ads ("Ads") on third party website or websites based on product listed on ClickBank® and PayDotCom® ("Products Banks"), allowing You to earn commissions from sales made by users who clicked the Ads displayed on Your website(s). Any additions or modifications to the Services, shall be in the sole discretion of AffiliatesGarage.com and will be subject to this Agreement. You are solely responsible for any fees, charges and expenses incurred by you in accessing and using the Services.
2. Disclaimer of Warranties
USE OF THE SERVICES AND ANY CONTENT AVAILABLE THEREON IS AT YOUR OWN RISK. WE PROVIDE THE SERVICES ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS AGREEMENT. The above exclusions may not apply in jurisdictions that do not allow the exclusion of certain implied warranties.
AffiliatesGarage.com uses reasonable efforts to ensure that the Services are available on a 24/7 basis. However, there will be occasions when the Service will be interrupted for maintenance, upgrades and emergency repairs or due to failure of telecommunications links and equipment that are beyond the control of AffiliatesGarage.com. AffiliatesGarage.com makes NO GUARANTEES about the availability of its Services. By using the Services you agree that AffiliatesGarage.com shall not be liable to you for any modification, suspension or discontinuance of the Services.
AffiliatesGarage.com makes NO GUARANTEES that website owners will sell products through AffiliatesGarage.com's service and make commissions.
The Products Banks may change product information, including price and availability without notice. AffiliatesGarage.com update product information regularly and strives to provide product information as correct and precise as possible, but AffiliatesGarage.com makes NO GUARANTEES about the correctness and preciseness of product information in our Services.
3. Third Party Links and Information
Our Services may contain links to websites operated by other parties. The linked websites are not under our control, and we are not responsible for the content available on any other Internet sites linked to from our Services. Unless otherwise stated, such links do not imply our endorsement of material on any other website, and we disclaim all liability with regard to your access to such linked websites. You access any other Internet sites linked to from our Services at your own risk. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such sites or resource.
Details regarding payment are handled by the Products Banks. As such, AffiliatesGarage.com makes NO GUARANTEES regarding future payments in the unlikely event that a) the Product Banks have temporary issues making commission payments, or b) the Product Banks shuts its affiliate programs and ceases making payments entirely. The Services rely on the availability of product data from the Product Banks. If for some reason this service is unavailable or is shut down permanently (for everyone or for the AffiliatesGarage.com service in particular), this agreement shall terminate. AffiliatesGarage.com is associated with the Product Banks to the extent that it is a member of the Product Banks' Affiliate programs. The use of the words "Product Banks", "ClickBank" or "PayDotCom" on the AffiliatesGarage.com website is not intended to imply any further affiliation with the Product Banks.
4. Limitation of Liability
IN NO EVENT WILL AffiliatesGarage.com, ITS EMPLOYEES, DISTRIBUTORS, SUPPLIERS, MERCHANT PARTNERS, BUSINESS ASSOCIATES, ADVERTISERS, DIRECTORS, OR AGENTS (COLLECTIVELY "PROTECTED PARTIES") BE LIABLE FOR ANY INDIRECT DAMAGES OR OTHER RELIEF ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICES INCLUDING, BY WAY OF ILLUSTRATION AND NOT LIMITATION, LOST PROFITS, LOST BUSINESS OR LOST OPPORTUNITY, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING LEGAL FEES, ARISING OUT OF SUCH USE OR INABILITY TO USE THE SERVICES, EVEN IF A PROTECTED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. IN NO EVENT WILL PROTECTED PARTIES' MAXIMUM CUMULATIVE LIABILITY UNDER THIS AGREEMENT EXCEED ONE DOLLAR ($1.00). Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
5. Privacy Policy
We do not collect any personal information. Period!
You are not required to register or provide any personal information in order to use our Services.
6. Intellectual Property Ownership
Domestic and international laws protect the entire contents of our Services, including intellectual property related to our Services. The owners of the intellectual property (including, but not limited to, copyrights and trademarks) are AffiliatesGarage.com, its affiliates, or other third party licensor. We remain the owner of all right, title, and interest in the Services.
7. Forum and Choice of Law
These Agreement shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflicts of law rules. The parties hereby submit to the jurisdiction of, and waive any venue objections against, the state and federal courts in Tel-Aviv, Israel. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to this Agreement or your use of the Services shall be filed only in courts located in the State of Israel, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or these Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred.
